1. About these terms

Bramble & Fleece ("we", "us", "our") operates this online store, including all related content, features, tools, products and services (the "Services").

These Terms of Service ("Terms"), together with our Privacy Policy and Refund Policy, set out the terms on which we sell products to you and on which you may use our site. Please read them carefully — they include important information about your rights and about the limits of our liability.

By browsing or ordering from our store, you agree to these Terms. If you do not agree, please do not use the Services.

Our store is powered by Shopify, which provides the platform that enables us to sell to you.

2. Who we are and how to contact us

If you need to contact us about an order or these Terms, email us and we will reply to the address you used.

3. Using our store

You must be at least 18 years old to place an order. If you allow anyone under 18 to use our store on a device you own or manage, you are responsible for their use of it.

To order, we may ask you for information such as your name, email address, and billing, payment and delivery details. You agree that the information you give us is accurate and complete, and that you will keep it up to date so we can process your order and contact you when needed.

If you create an account, you are responsible for keeping your login details secure and for activity that takes place under your account. You may not transfer, sell or licence your account to anyone else.

4. Our products

We make every effort to represent our products accurately. Colours and finishes may look different on your screen depending on your device and its settings, and natural materials vary slightly from item to item. Product images are illustrative.

We may change product descriptions, limit quantities, or discontinue a product at any time.

Nothing in this section affects your legal right to receive goods that are of satisfactory quality, fit for purpose and as described.

5. Orders

When you place an order you are making an offer to buy. We accept your order when we email you to confirm that it has been dispatched — at that point a contract comes into existence between us.

We may decline an order, for example if the product is unavailable, there has been a pricing or description error, your payment is not authorised, or we suspect fraud or resale. If we decline, we will let you know and refund any payment in full.

Please check your order carefully before submitting it. If you need to change or cancel an order after placing it, contact us as soon as possible and we will help if the order has not yet been dispatched. This is in addition to your legal cancellation rights in section 8.

You confirm that you are buying for your own personal or household use, and not for commercial resale.

6. Prices and payment

Prices are shown in [CURRENCY] and include VAT where applicable. Delivery costs are not included unless stated and are shown at checkout before you pay. For orders shipped outside the UK, you may be responsible for customs duties, import charges and local taxes.

The price you pay is the price in effect when you place your order, as set out in your order confirmation. Prices, discounts and promotions may change without notice. Promotions may be subject to their own terms and conditions, which take precedence over these Terms where they conflict.

By submitting payment details you confirm that you are authorised to use the payment method and that the details you have given are correct and complete.

7. Delivery

Delivery times shown on our site are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or other events outside our reasonable control, but we will keep you informed and, where a delay is substantial, you may cancel your order and receive a refund for anything not yet delivered.

Goods become your responsibility once they are delivered to the address you gave us. You own them once we have received payment in full.

8. Cancellations, returns and refunds

If you are a consumer in the UK, you have a legal right to cancel most online orders within 14 days of receiving your goods, and a further 14 days to return them, without giving a reason. Certain items are excluded, including personalised or made-to-order goods and sealed items that have been unsealed after delivery.

If an item is faulty, damaged or not as described, you have separate legal rights to a repair, replacement or refund. Nothing in these Terms or in our Refund Policy affects those rights.

9. Intellectual property

Everything on our site — text, images, graphics, video, audio, product photography, branding, and the design, selection and arrangement of it — is owned by us or our licensors and is protected by copyright, trade mark and other intellectual property laws in the UK and internationally.

You may use the site for your own personal, non-commercial use. You must not reproduce, copy, modify, create derivative works from, republish, distribute, store or transmit any part of it without our prior written permission. All rights not expressly granted are reserved.

"Bramble & Fleece", our logos, product names and slogans are our trade marks and may not be used without our written permission. Shopify's name, logo and product names are trade marks of Shopify. All other trade marks belong to their respective owners.

10. Third-party links and tools

Our site may contain links to, or embedded functionality from, websites and services operated by third parties. We do not control or monitor these and we provide access to them "as is", without warranties of any kind and without endorsement.

If you leave our site or use a third-party tool, you do so at your own risk and under that third party's terms. We are not responsible for third-party content, products or services, and any questions or complaints about them should be directed to the third party.

11. Reviews and feedback

If you send us reviews, ideas, suggestions, photos or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free, sub-licensable licence to use, reproduce, modify, publish, distribute and display it in any medium, including for marketing purposes.

You confirm that the Feedback is yours to share, that you have disclosed any payment or incentive you received in connection with it, and that it does not infringe anyone's rights or contain anything unlawful, abusive, defamatory, obscene or malicious. You must not use a false email address or pretend to be someone else.

We are not obliged to keep Feedback confidential, to pay for it, or to respond to it, and we may edit or remove Feedback we consider inappropriate.

12. Things you must not do

You may use our store for lawful purposes only. You must not:

  • break any applicable law or regulation, or use the site for any unlawful or malicious purpose;
  • infringe our intellectual property rights or those of anyone else;
  • harass, abuse, threaten, defame or harm our staff or any other person;
  • post or transmit false or misleading information;
  • send spam, chain messages or unsolicited advertising;
  • impersonate any other person or organisation;
  • upload viruses or any other malicious code;
  • collect or track other people's personal information;
  • copy, extract, resell or otherwise exploit any part of the Services; or
  • interfere with, bypass or circumvent the security measures we use to protect the site.

We may suspend or close your account without notice if we reasonably believe you have breached these Terms.

13. Automated access and AI agents

An "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or organisation without direct supervision.

If you use, enable or deploy an Agent to access our Services, it must at all times:

  • identify itself in the user agent string of every request in the form "Agent/[agent name]";
  • not conceal that it is an Agent, including by mimicking human behaviour or by completing or circumventing CAPTCHAs and similar checks;
  • answer truthfully if asked whether an interaction is coming from a human or a machine; and
  • not circumvent any measure we use to block, limit or control automated access.

We may limit or block Agent access by technical or other means, and an Agent must stop accessing the Services if we ask it to.

14. Errors and inaccuracies

Occasionally information on our site may contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, delivery charges, delivery times or availability. We may correct these and may cancel an affected order, even after you have submitted it. If we cancel, we will refund you in full.

If a product's correct price is higher than the price shown, we will contact you before dispatch to ask whether you want to continue at the correct price. If a pricing error is obvious and you could reasonably have recognised it as a mistake, we do not have to supply the product at the incorrect price.

15. Our relationship with Shopify

Bramble & Fleece is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Bramble & Fleece. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Bramble & Fleece, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Bramble & Fleece.

16. Privacy

All personal information we collect through the Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify also collects and processes information about your use of the site in order to provide and improve it. Information you submit may be shared with Shopify and its partners, who may be located outside the UK. Our Privacy Policy explains this in more detail, and Shopify's own privacy policy is available on its website.

17. Our responsibility for loss or damage

We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to products (including the right to receive goods that are as described, of satisfactory quality and fit for purpose), and under the Consumer Protection Act 1987.

Information on our site is provided for general information only. We do not warrant that it is accurate, complete or up to date, or that the site will be available uninterrupted, secure or error-free. Any reliance you place on general information on the site is at your own risk.

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking them. We are not responsible for loss or damage that is not foreseeable.

We supply our products for domestic and private use. If you use them for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

18. Termination

We may end your access to the Services, or any part of them, at any time if you breach these Terms. You will remain liable for any amounts due up to the date access ends.

Sections that by their nature should continue to apply after termination will do so, including sections 9, 11, 15, 17, 20 and 21.

19. Changes to these Terms

We may update these Terms from time to time. The current version is always available on this page, and the Terms that apply to your order are the ones in force at the time you placed it.

Where a change is material, we will notify you in accordance with applicable law. Your continued use of the Services after a change is posted means you accept the updated Terms.

20. General

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be severed and the remaining provisions will continue in full force.

If we do not immediately insist that you do something you are required to do under these Terms, or delay in taking action against you in respect of a breach, that will not mean we have given up our rights.

These Terms, together with our Privacy Policy and Refund Policy, form the entire agreement between us in relation to your use of the Services and any order you place.

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations to another organisation; we will tell you if this happens and it will not affect your rights under these Terms.

21. Governing law and complaints

These Terms are governed by the law of England and Wales, and any dispute will be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
